A HECM converts that accumulated appreciation into loan proceeds (which are not taxable income) without triggering a capital-gains event from a sale. Utah also has its own reverse-mortgage statute — the Utah Reverse Mortgage Act, Title 57 Chapter 28 — which layers state-level disclosure and counseling requirements on top of federal HECM rules. The Utah Reverse Mortgage Act — what it adds on top of federal HECM rules

Utah is one of the few states with its own reverse mortgage statute — the Utah Reverse Mortgage Act, Title 57 Chapter 28, originally enacted in 2015 and amended in 2023. It doesn't replace federal HECM rules; it adds two state-level layers:

§57-28-203 — Application-time disclosures. Utah lenders must provide written disclosures at the time of application covering total annual loan cost, loan terms and conditions, borrower rights, and alternatives. This is layered on top of federal HUD disclosures.

§57-28-204 — Independent counseling. For HECM borrowers, counseling must occur before FHA assigns a case number to the loan (which aligns with federal timing but is codified as a state requirement, giving Utah borrowers a state-law cause of action if the requirement is skipped). For non-federally-insured (proprietary/jumbo) reverse mortgages, counseling must occur before the borrower signs the application. The counselor must also provide a written disclosure that a reverse mortgage may have tax consequences, may affect eligibility for state and federal assistance programs, and may impact the borrower's estate and heirs.

Utah does not add a state-specific cooling-off period beyond the federal 7-day right of rescission.

Utah's post-boom equity — why timing your HECM matters here

Utah's home prices rose roughly +53% between 2020 and 2025 per the FHFA HPI — one of the steepest five-year appreciation runs in the country during that period. For a HECM borrower this matters in a specific way: the principal limit is calculated at closing based on your home's current appraised value. Lock in when values are elevated and you lock in a higher principal limit. If Utah prices plateau or soften (as they have modestly in some markets already), waiting means borrowing against less equity later.

This does not mean rushing into a HECM you don't need — it means that Utah's specific appreciation history reshapes the "when" question. A HECM you might have considered five years ago at $350K on a Salt Lake home now applies to a $550K home. Talk through the timing with a HUD-approved counselor before deciding.

Utah Circuit Breaker and Mandatory Senior Deferral — how HECMs interact

Utah's Circuit Breaker Homeowner's Tax Credit provides up to $1,412 in property tax abatement (2025 schedule) for Utah homeowners age 67 or older with household income below $44,221. The credit scales with income — full $1,412 at $15,033 or below, down to $262 at $39,797–$44,221.

Utah's Mandatory Senior Property Tax Deferral (age 75+, household income ≤$88,442) allows eligible seniors to defer property taxes at half the normal interest rate, with no delinquency penalties.

HECM interaction: HECM loan proceeds are not taxable income for federal purposes, so they should not affect how the Circuit Breaker counts your income. But — as the state-mandated counseling disclosure under §57-28-204 warns — a reverse mortgage may affect eligibility for state assistance programs. If you're claiming Circuit Breaker, confirm with your county assessor and a tax advisor that HECM disbursements don't inadvertently push your counted household income above the $44,221 threshold in the year of disbursement.

If your mortgage or deed of trust holder must approve tax deferral in writing (the case for the Utah program), a HECM servicer will typically not approve it — factor that in.

Park City, high-value Wasatch Front, and the jumbo question

The 2026 HECM lending limit is $1,249,125 nationwide. Utah's Park City had a typical home value of roughly $1.57 million in mid-2026 — meaning Park City HECMs are capped at the $1,249,125 figure regardless of actual appraised value. Homeowners in high-value Wasatch Front pockets (parts of Federal Heights, Emigration Canyon, Alpine, Deer Valley) can hit the cap as well.

Above the cap, the choices are:

  1. Accept the FHA-capped principal limit (still substantial at $1,249,125).
  2. Explore a proprietary (jumbo) reverse mortgage. These are offered by private lenders like Longbridge Financial, Finance of America Reverse, and others; claim amounts can reach $4M or more; they are not FHA-insured, meaning no upfront FHA mortgage insurance premium but also no FHA non-recourse insurance protection.
  3. Stay put and use other retirement-income levers.

Utah's Reverse Mortgage Act governs both HECMs and non-federally-insured reverse mortgages, so state counseling requirements apply either way.

Can I combine Utah's Mandatory Senior Property Tax Deferral with a HECM?
