# Virginia Reverse Mortgage in 2026: The Local-Option Senior Tax Patchwork, No Dedicated State Statute, and County-by-County Payouts

Virginia does not have a dedicated reverse mortgage act — the federal HUD HECM framework does the substantive work. What Virginia adds is a **local-option senior tax patchwork** under [Va. Code § 58.1-3210](https://law.lis.virginia.gov/vacode/title58.1/chapter32/section58.1-3210/): every county and independent city sets its own income limits, net-worth caps, and deferral rules for the "real property tax exemption for the elderly and handicapped." That means the exact same HECM borrower can have very different property-tax outcomes depending on whether they live in Fairfax County, Virginia Beach, or Richmond — and the same HECM draw can affect eligibility differently under each locality's rules.

## Virginia senior homeowner market

Virginia's senior homeowner base spans two very different worlds: the high-cost Northern Virginia inner suburbs (Fairfax, Arlington, Loudoun) and the lower-cost Hampton Roads, Richmond, and Southwest Virginia markets. HECM math and local senior-tax eligibility both shift accordingly.

## Where the FHA cap actually matters in Virginia

Most Virginia markets sit comfortably under the 2026 FHA HECM lending limit of $1,249,125. The exception is inner Northern Virginia: single-family homes in McLean, Great Falls, parts of Arlington, and much of western Loudoun routinely exceed $1.5–2 million. On those properties the standard HECM principal-limit calculation caps at $1,249,125 regardless of appraisal. A proprietary (jumbo) reverse mortgage — not FHA-insured, no HUD cap — is usually the alternative to price out.

## Virginia's (missing) reverse mortgage statute

Virginia has no reverse-mortgage-specific act comparable to Maryland's or North Carolina's. Federal HUD HECM rules — mandatory counseling, non-recourse limits, non-borrowing-spouse protections, occupancy rules — do essentially all of the substantive work. General Virginia consumer-finance and mortgage disclosure protections apply on top, but there is no state-imposed cooling-off period, cross-selling ban, or checklist requirement layered onto a Virginia HECM the way there is in Illinois or Maryland.

## The § 58.1-3210 local-option patchwork

[Va. Code § 58.1-3210](https://law.lis.virginia.gov/vacode/title58.1/chapter32/section58.1-3210/) authorizes — but does not require — every county, city, and town in Virginia to grant real property tax exemption or deferral to persons 65+ or permanently and totally disabled. Under general Virginia guidance and consistent federal treatment, HECM proceeds are loan advances, not income, and generally do not count against the income limits used in § 58.1-3210 programs.
